Terms of Use for Emotion360.AI

1. Acceptance of Terms
By accessing, registering, or using the Emotion360.AI platform (collectively referred to as the "Service" or "Platform"), including features such as "Fraud Detection," "Love Detector," "Call Center," and other functionalities, you agree to comply with these Terms of Use. If you do not agree, please do not use our Service. These Terms are legally binding and apply to all users worldwide, including individuals, businesses, and organizations.
2. Rights of Use

Description of Service:
Emotion360.AI offers advanced AI solutions for emotion analysis, fraud detection, communication support, and skill development (including, but not limited to, "Fraud Detection – Band Fraud Check / General Fraud Check," "Love Detector," "Call Center," "Personal Coaching," and "Data Analysis").

User Rights and Restrictions:
You may only use the Service for lawful purposes and are prohibited from copying, distributing, or misusing it (e.g., abusing AI for fraud, spreading misinformation, or harming others or organizations). You must not use the Service to analyze illegal data or infringe on others’ privacy.

Login and Security:
Some advanced features (e.g., detailed data analysis, usage history) require login. You are responsible for securing your account, password, and any authentication information (e.g., two-factor authentication – 2FA). You agree not to share account information with third parties and must notify us immediately at contact@emotion360.ai if you detect unauthorized access.
3. Limitation of Liability
- AI Accuracy: Emotion360.AI uses AI to analyze emotions, behavior, and detect fraud, but we do not guarantee 100% accuracy. Results depend on the quality of your input data (e.g., voice quality, text, or communication context). We are not liable for any damages arising from misinterpretation, misuse, or undesired results from the Service.
- Service Interruptions: We do not guarantee that the Service will operate continuously, without interruption, or error-free. We may temporarily suspend the Service for maintenance, updates, or technical issues.
- Maximum Liability: In the event of a dispute, our liability is limited to the maximum amount you have paid for the Service (if any) in the 12 months prior to the incident, or $1,000 USD (or equivalent local currency), whichever is lower.
4. Termination of Service
We reserve the right to suspend, restrict, or terminate your account if you violate these Terms.
- You violate these Terms (e.g., using the Service for fraud, unauthorized data sharing, or AI abuse).
- You use the Service unlawfully, negatively impact the system, other users, or Emotion360.AI’s reputation.
- There is evidence of fraudulent behavior, security breaches, or legal violations (e.g., using "Fraud Detection" for illegal activities).
Termination may occur without prior notice in serious cases. We will notify you via email (contact@emotion360.ai) or on the platform if possible.
5. Intellectual Property
All content, technology, icons, software, AI algorithms, and designs of Emotion360.AI, including but not limited to the AI models used in "Fraud Detection," "Love Detector," and "Call Center," are the property of us or our licensed partners. You may not copy, modify, distribute, or use them without our written permission.
Any feedback, suggestions, or ideas you provide about the Service become our property without compensation, and we may use them without restriction.
6. Payment, Subscription, and Plans
Some features or service plans (e.g., advanced analysis, detailed usage history) may require registration or payment. You agree to pay on time through our provided methods (e.g., credit card, PayPal) and not use unlawful payment methods.
We may change pricing, discontinue plans, or introduce new plans without prior notice but will notify you via email (contact@emotion360.ai) or on the platform if it affects your account.
You may cancel your subscription at any time, but refunds are not available unless otherwise agreed.
7. Changes to Terms
We may update or modify these Terms at any time to comply with laws or improve the Service. Updates will be posted on the platform, notified via email (if you are registered), and you should check periodically. Continued use of the Service after changes indicates your acceptance of the new terms.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of Vietnam, but if you are in another region, we also comply with local laws such as:
- GDPR (Europe): Regulations on personal data protection in the European Union.
- CCPA (California, USA): California Consumer Privacy Act for consumer privacy rights.
- Vietnam’s Cybersecurity Law: If you use the Service from Vietnam, we comply with data storage and security requirements under this law.
Any disputes will be resolved through negotiation within 30 days. If no agreement is reached, disputes will be resolved in:
- The competent courts of Hanoi, Vietnam, for users in Vietnam.
- The competent courts in your region under local laws (e.g., Ireland for EU users, California for US users) if you are outside Vietnam.
